NEW DELHI: The Supreme Court has requested a response from the Election Commission following a plea by Naam Tamilar Katchi, an unrecognized political party based in Tamil Nadu, challenging the allocation of free symbols to such parties on a first-come, first-served basis.
A bench led by Chief Justice D Y Chandrachud, along with Justices JB Pardiwala and Manoj Misra, also issued a notice to another unrecognized political party that received the poll symbol previously held by Naam Tamilar Katchi.
This development comes after the high court, on March 1, dismissed NTK’s petition contesting the Election Commission’s allocation of free symbols to unrecognized parties in a first-come, first-served manner. The court rejected NTK’s argument that the Election Symbols Order governing this process was arbitrary and unconstitutional, emphasizing the importance of providing free symbols.
NTK was displeased by the assignment of the ‘ganna kisan’ (sugarcane farmer) symbol to another political party in Tamil Nadu and Puducherry for the upcoming Lok Sabha elections. The Supreme Court has scheduled the hearing of the appeal post the Holi vacation, indicating a review of Paragraph 10B (B) of the Election Symbols Order regarding the allocation of free symbols based on the first-come, first-served principle.
