This Appeal has been filed with 197 days delay in refiling the Appeal. Learned counsel for the Appellant submits that a document was to be filed alongwith the Appeal which has foreign origin – Sharjah, United Arab Emirates. He submits that time was taken to obtain translated copy of the document.
Learned counsel for the Respondent No.1 opposing the submission submits that the document has no relevance in the present Appeal and no letter has been annexed by the Appellant with such intimation which was sent to the Registrar.
Sufficient cause has been shown to allow application for condonation of delay of 197 days in refiling the Appeal subject to payment of a cost of Rs.10,000/- (Rupees Ten Thousand Only) to the Respondent No. 1. The cost shall be paid by the Appellant within two weeks.
Learned counsel for the Appellant seeks liberty and is allowed to file an Additional Affidavit within two weeks.
