The Bombay High Court granted bail to Mojo’s Bistro owner Yug Tuli, who was one of the accused in the 2017 Kamala Mills fire case.

The Bombay High Court on Wednesday granted bail to Yug Tuli, the co-owner of Mojo’s Bistro where a fire had broken out on December 29, 2017. The incident killed 14 people and injured more than 50 others.

Tuli had surrendered himself to the police after evading arrest, two weeks after the fire broke out. He was booked under sections of culpable homicide not amounting to murder.
Tuli had approached the Supreme Court in 2018 after the Bombay High Court rejected his bail. The Supreme Court had also dismissed his application. However, the apex court had granted liberty to Tuli to file a fresh bail application after three months.

Tuli then filed an application for bail before the trial court but was again rejected. Thereafter, he filed a Special Leave Petition (SPL) in the Supreme Court challenging the trial court’s order.
The Supreme Court then granted him interim bail till the matter was taken up by the High Court and Tuli walked out of jail after 11 months.
Tuli’s advocates told the court that all the accused in the case have been released on bail and it is just his bail petition that is still pending in court.
They said, “The co-accused Yug Pathak, who was Tuli’s partner in Mojo’s Bistro, was released by the Supreme Court in December 2018. Tuli is similarly situated and deserves to be released on bail on the grounds of parity.”
Justice AS Gadkari granted his bail after taking into consideration that all his co-accused had been released. He added that after Tuli was released on interim bail in December 2018, there has been no report of any breach of the conditions imposed on him.
