The division bench of the Madras High Court comprising justices M Duraiswamy and Sunder Mohan, dismissed all sub applications, including the contempt filed against AIADMK joint coordinator Edappadi K Palaniswami and other party leaders, since the Supreme Court, on Wednesday, July 6 had stayed their order.
The court also granted liberty to M Shunmugum, who belongs to the O Panneerselvam (OPS) faction, to revive the applications and file a special leave petition with the Supreme court.
The division bench dismissed the contempt petition filed against Edappadi Palaniswami (EPS) for violating the bench’s order restraining the general council (GC) from passing any resolutions other than the 23-already mentioned ones, which were already presented to OPS.
The Supreme Court, on July 6, ordered the warring AIADMK factions to resolve their issues in the general council meeting scheduled for July 11,or in the civil suit pending before the Madras High Court.
The bench of Justices Dinesh Maheshwari and Krishna Murari questioned the correctness of the High Court order issued on June 23.
“What happens within the party are matters which are happening there. Can an appellate court substitute its discretion for that of the internal party?” the bench remarked.
