NEW DELHI: Should retired high court judges get salary in addition to pension when they become ombudsman in an organisation? Supreme Court on Friday agreed to examine the issue and issued notice to Kerala govt.
Justice K K Denesan, a retired Kerala HC judge, through senior advocate V Giri said that as ombudsman for local self govt institutions, Kerala HC has denied the salary and allowances over and above the pension he was entitled to as a retired HC judge.
A bench led by CJI D Y Chandrachud said all retired HC and SC judges, when they are appointed to tribunals as members or chairpersons, receive salary and allowances minus the pension they receive as retired judges. Giri pointed out that the single-judge bench of HC allowed Justice Denesan’s petition and allowed him to draw full salary and allowances in addition to the pension paid to him, but the division bench of HC reversed the decision citing norms prevalent in other tribunals, which is inapplicable to local self govt service rules pertaining to ombudsman. SC issued notice to Kerala govt and agreed to examine the issue.
