As the battle for control over AIADMK reaches the Supreme Court, the SC bench advised the leaders to decide the internal matters of the party in the general council instead of approaching court for interference.
Senior Advocate Maninder Singh said in court that there was an agreement between AIADMK senior leader O Panneerselvam (OPS) and AIADMK cadres supporting Edappadi K Palaniswami (EPS) for joint control of the party.
“The person, who has been a chief minister from 2017 till today, now wants to throw out the joint control that has been in place and make it unilateral,” said Singh in court.
Answering to this, the Supreme Court said, “What happens within the party are matters which are happening there. Can the appellate court substitute its discretion for that of the internal party?”
The advocate then said, “We are being left without a solution because a single judge says there is no prima facie case. A total of 23 decisions have been drafted. The division bench has said that only the draft resolutions approved by them can be discussed and nothing else. Even with regard to the Association, at the level where it decides its affairs and functioning, if there is any difference which is creating a dispute over its functioning, it requires judicial review.”
Reiterating its statement, the Supreme Court said that “friendships and disputes have to be worked out internally.”
