Congress Leader Abhishek Singhvi, reacting to the media on July 07, said that the case against Rahul Gandhi was the misuse of defamation law. In a Press Conference held in Delhi, Abhishek Singhvi said, “Jurisprudence found in the judgement is unique and extraordinary… It has no parallel or precedent in the jurisprudence of the law of defamation. How on earth can any member of this group variously describe to number 13 crores or 10 crores. The Court appears to hold indirectly that any member of that 13 crore community can stand up and say they have been defamed.” “There is not a single case or precedent in the law of defamation in India that such a large community being defamed, any member of the community can stand up to file defamation, and without showing any personal loss or malice by the accused,” he added. Notably, the Gujarat High Court on July 07 refused to stay Congress leader Rahul Gandhi’s plea seeking a stay on his conviction in the ‘Modi surname’ defamation case. The bench of Justice Hemant M Prachchhak said that the trial court conviction order is proper.
